  1. In Texas, bicycle riders can’t be charged with DUI/DWI. State law defines those for motorized vehicles. But as the Austin Chief of Police recently pointed out (quite strongly) at a recent ACA meeting, you can be charged with public intoxication. This includes arrest and impoundment of the “vehicle” based on officer’s judgement.

    Should the DWI law be rewritten? Perhaps. Not sure if cycling under influence is a huge problem but in the interest of fairness…
