It seems perfectly reasonable to us to apply DUI laws to cyclists. What seems ludicrous is to call resulting violations DUIs. We have proposed “RUI” for riding under the influence, and yes, it should apply to horseback riders too. That means YOU John Wayne!

In Texas, bicycle riders can’t be charged with DUI/DWI. State law defines those for motorized vehicles. But as the Austin Chief of Police recently pointed out (quite strongly) at a recent ACA meeting, you can be charged with public intoxication. This includes arrest and impoundment of the “vehicle” based on officer’s judgement.
Should the DWI law be rewritten? Perhaps. Not sure if cycling under influence is a huge problem but in the interest of fairness…
